These Terms of Service (“Terms”) govern your access to and use of the website www.1percentperformance.com (the “Website”), its content, and any related products or services (including meal plans, coaching, nutrition guidance, apps, etc.) offered by 1 Percent Better Performance LLC (“we,” “us,” or “our”). By using the Website or purchasing our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or services.

By accessing, browsing, or using our Website or purchasing services, you acknowledge that you have read, understood, and agree to these Terms, as well as any updates or modifications we may make from time to time.

2. Your Use of the Website & Services

  • You agree to use the Website and services only for lawful purposes and in a manner that does not infringe the rights of others or restrict anyone else’s use and enjoyment of the Website.

  • You must not misuse the Website (e.g., by hacking, transmitting malware, attempting to gain unauthorized access to other accounts or systems, etc.).

  • If you are using coaching services, meal plans, or health-related services, you acknowledge that your use of the information provided is at your own risk, and it is not a substitute for professional medical advice.

3. Account Registration & Payment

  • If you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

  • Payment for services must be made in full (or per any installment plan agreed upon) before those services are delivered, unless otherwise specified.

  • Refunds, cancellations, or pauses of services are subject to our Refund / Cancellation Policy

4. Intellectual Property

  • All content provided on the Website (text, designs, images, videos, software, logos, etc.) is owned by us or our licensors, and is protected by copyright, trademark, and/or other intellectual property laws.

  • You may use the content only for your personal, non-commercial use, unless you receive express written permission otherwise.

  • You may not copy, reproduce, republish, upload, post, transmit, or distribute content in any way without our permission.

5. User‐Generated Content

  • If you post reviews, comments, feedback, or other user content (“User Content”), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, publish, distribute, and display that content in any media.

  • You represent and warrant that any User Content you submit is your own, does not infringe others’ rights, and is not misleading, defamatory, or unlawful.

  • We reserve the right (but are not obligated) to monitor, edit, or remove any User Content that violates these Terms.

6. Disclaimers & Health / Nutritional Advice

  • The content, meal plans, programs, and coaching advice we provide are for general health, wellness, and fitness purposes. They are not medical advice. If you have, or suspect you have, a medical condition, you should consult a healthcare professional.

  • We do not promise any specific results. Individual results vary, and many factors affect outcomes (diet, exercise, genetics, etc.).

7. Limitation of Liability

  • To the fullest extent permitted by law, we (and our affiliates, employees, agents) are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Website or services.

  • Our total liability (for any claim) shall be limited to the amount you paid for the services in question (if any).

8. Indemnification

You agree to indemnify, defend, and hold harmless 1 Percent Better Performance LLC, its officers, directors, employees, agents, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of the rights of another person.

  • These Terms shall be governed by the laws of the state of Michigan without regard to conflict of law rules.

  • You agree that any legal suits, actions or claims arising out of or related to these Terms or your use of the Website shall be brought exclusively in the federal or state courts located in Michigan.

We reserve the right to modify or revise these Terms at any time. Any changes will be effective once posted on the Website, with an updated Effective Date. Your continued use of the Website or services after the changes are posted constitutes your agreement to the modified Terms.
